Eastman Kodak Company (EK - 2.85) won a courtroom victory on Thursday, when an International Trade Commission (ITC) judge ruled that the camera king did not infringe on digital technology patents held by Apple (AAPL). However, this is simply one battle within the war for EK. The full ITC will vote to uphold or strike down the judge's decision in a ruling due Sept. 19, while the group is expected to weigh in on EK's own patent complaint against Apple and Research In Motion Limited (RIMM) later this month.
EK has gained 7.4% ahead of the open, with the shares looking to tackle resistance in the $2.90-$3 neighborhood. However, given the stock's year-to-date deficit of nearly 47%, EK's path higher is hardly clear. Specifically, stubborn resistance from the equity's 10-week moving average is lingering overhead in the $3.16 region.
In light of EK's dismal price action, it's not too surprising that analysts are unanimously skeptical. Zacks reports zero "buy" ratings for the stock, compared to two "holds" and three "sell" or "strong sell" recommendation
